United States This is an issue that requires immediate attention. These issues effect everyone big and small, whether you are a software engineer or a babysitter, and threatens the future of America to remain the world leader in technology and innovation. The trolls hurt small businesses, the middle class, and flush billions of taxpayer dollars down the toilet. I personally think that software patents should completely cease to exist, however I can also see the logic in having them. I think that the rules should be as tight as possible. I think that only certain types of software should be patentable. They should mostly be limited to lower level concepts such as software drivers, communication protocols, firmware, embedded systems, etc. The patent should not encompass a broad series of constructs. General ideas for the purpose/service that an application is to provide, nor user interfaces should not be patentable. Strongly defined architecture, or specific algorithms should qualify if they are very specific in what aspects of the logic are to be patented and why. Programming logic that would be considered to be a common, natural, or intuitive approach should not be patentable. Those are just a few general things that come to mind. I think that it ultimately comes down to the patent being very explicit in what is covered under the patent. The success of any challenge that the patent holder makes based on ambiguity of verbiage should not lean away from the patent holder. It should be a requirement for those filing a patent to be explicit in meaning, and should be responsible for including any and all disambiguation of possible interpretations. 2 years 1 month ago
